Payment & Bidder Agreement
The following, as amended by any posted notices or announcements during the sale, constitutes the entire terms and conditions on which property listed in the catalog shall be offered for sale or sold by YORKSHIRE ESTATE AUCTIONS, LLC. PLEASE READ THIS ENTIRE AGREEMENT.
ALL GOODS ARE SOLD "AS IS" "WHERE IS". ALL SALES ARE FINAL. Condition reports in Auction catalog are not guaranteed and may vary in accuracy. It is the responsibility of prospective bidders to inspect the goods. All condition reports, measurements, opinion of values, age and quality are offered by Yorkshire Estate Auctions but are not guaranteed. Neither the auction house, nor the consignor, is responsible for the accuracy of printed or verbal descriptions or its authenticity. All jewelry items sold by Yorkshire Estate Auctions are evaluated by third party appraisal firms where certified GIA gemologists evaluate the weight, size and grade of gemstone and/or metal to determine the replacement value of the item. Please be advised that all appraisals are done for insurance purposes only and do not determine the actual value of the jewelry on auction. The appraisals are done for the sole purpose of protecting the buyer in the event of damage or loss of purchased jewelry items from Yorkshire Estate Auctions. Yorkshire Estate Auctions is not responsible for the opinions and appraisals of any third party appraisal firms and their experts.
Yorkshire Estate Auctions and its representatives do not claim any expertise. Any condition statement is given as a courtesy to a client, it is only an opinion and should not be treated as a statement of fact. Yorkshire Estate Auctions shall have no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. Any dispute of purchase must be made within 7 days of sale.
Each lot sold at the auction is subject to an 18% buyer’s premium, in addition to the hammer price for each lot. All purchases in the state of California are subject to the applicable state sales tax (9%) unless the purchaser has a valid tax exemption number that will be applied to the invoice.
Lots may have reserves or minimum selling prices. This confidential figure is set by consignor and Yorkshire Estate Auctions. Yorkshire Estate Auctions will exercise all reserve bids. The record of sale kept by the auction house is final in any dispute. Digital recordings of the sale will be used for confirmation.
Buyer takes responsibility of the property as soon as the item gets "sold on the block". The auction house may choose to resell items if terms for removal are not met.
Payment is due at the end of each sale. We accept cash (In House Only), checks, PayPal, Traveler's checks, major credit cards or debit cards. Yorkshire Estate Auctions reserves the right to hold property until checks clear. A $25 fee will be charged for all returned checks. If a check fails to clear after second deposit, the purchaser will be held responsible for any and all fees incurred until we have collected good funds, including storage charges. Bad checks, fraudulent credit cards of purchases will be reported to the police and will be prosecuted by Yorkshire Estate Auctions to the fullest extent of the law. Buyers who fail to pay will be liable for any lost fees gallery may incur. Bidder shall be responsible for all costs of collection, including court costs and reasonable attorney's fees. By participating in Yorkshire Estate Auctions through the internet, bidders consent to the jurisdiction of the Courts where the auctions are held.
